These terms govern your use of tbsol.net and the tools we provide (client portals, CRMs, capture pages, and marketing software — together, the "Services"), operated by TB Solutions of Chester County, Pennsylvania. By using the Services, you agree to these terms.
We provide digital marketing services (websites, advertising, automation, AI tools) and software that supports them. Specific project work — scope, pricing, timelines, and deliverables — is agreed per project in writing (including by email or through our intake and proposal process).
You're responsible for your account credentials and for activity under your account. Give us accurate information and keep it current. We may suspend accounts that abuse the Services, attempt to access others' data, or use the Services unlawfully.
Unless agreed otherwise in writing: project work is billed half up front and half on completion; recurring services are billed monthly in advance and can be canceled ahead of the next billing period. Fees for completed work are non-refundable. Late amounts may pause work.
You keep ownership of your business content and your customer data. You give us the rights needed to host, process, and display it in order to provide the Services. If you run lead capture through us, you're responsible for using those leads lawfully (including consent for any calls, texts, or emails you send them).
On full payment, you own the final deliverables created for your project (your website content, ad creatives, copy). We keep ownership of our platform, tools, templates, and know-how, and the right to use similar techniques for other clients. We may reference completed work in our portfolio unless you ask us not to.
Some deliverables are produced with AI assistance. You're responsible for reviewing AI-generated content before publishing it — accuracy, legal claims, and fit for your business are your call.
Don't use the Services to send spam, break the law, infringe others' rights, submit false information, probe or overload our systems, or attempt to access data that isn't yours.
The Services depend on third-party providers (hosting, databases, email, AI, payments). We're not responsible for their outages, but we'll work in good faith to restore service quickly.
If you provide a mobile number to us or to a business using our platform, you may receive recurring automated text messages (appointment confirmations and reminders, loyalty and rewards notifications, and occasional offers). Consent is not a condition of purchase. Message frequency varies and message & data rates may apply. Reply STOP to cancel or HELP for help at any time. Full details are in our SMS Terms, and mobile information is handled per our Privacy Policy — we never sell or share mobile opt-in data for marketing.
Marketing outcomes vary — we don't guarantee specific results, rankings, lead volumes, or revenue. The Services are provided "as is." To the fullest extent allowed by law, our total liability for any claim is limited to the amount you paid us in the three months before the claim arose, and we're not liable for indirect or consequential damages (including lost profits or lost data beyond our reasonable control).
Either of us may end recurring services with notice before the next billing period. On termination we'll provide a reasonable export of your data on request. Sections 4–9 survive termination.
These terms are governed by the laws of the Commonwealth of Pennsylvania. Disputes will be handled in the state or federal courts located in Pennsylvania.
We may update these terms; we'll post changes here with a new effective date. Continued use after changes means you accept them.
